The Respondent operates a NPDES permitted Wastewater Treatment Plant on Seneca Nation of Indian Territory in Salamanca, NY. EPA conducted an inspection of the WWTP on July 28, 2016 and identified that the WWTP was not complying with the terms and conditions of its NPDES Permit, including numeric effluent limit violations for BOD, TSS, flow, Fecal Coliform and Total Residual Chlorine, as well as failure to develop and implement a Preventative Maintenance Plan, and a Stormwater Pollution Prevention Plan, failure to conduction Comprehensive Site Compliance Inspections and failure to property operate and maintain the WWTP. An Administrative Order is being issued to order the facility to comply with Permit conditions.
