On May 19, 2015 EPA conducted a compliance inspection of PVS Technologies' Detroit, MI facility to determine its compliance with the RMP regulations - CAA 112(r)(7). Based on the inspection, EPA determined that Respondent violated the following regulations: 1. failed to estimate the population within a circle at its center at the point of a chlorine release; 2. failed to use the most recent census data to estimate population adversely affected by a chlorine release; 3. failed to list environmental receptors within the distance required; 4. failed to keep records of the data used to estimate population and end environmental receptors potentially affected; 5. failed to document that equipment complies with good engineering practices; 6. failed to address its process hazard analysis previous incidents; 7. failed to address stationary source siting in its process hazard analysis; 8. failed to address human factors in its process hazard analysis; 9. failed to address a qualitative evaluation in its process hazard analysis of the range of possible safety and health effects of failure of controls; 10. failed to provide refresher training on the operating procedures; and 11. failed to include in its risk management plan the maximum quantity of chlorine in the process. A civil penalty of $8,800 was assessed.
