On January 3, 2017, Region 1 filed a consent agreement and final order (CAFO) resolving Clean Water Act violations against the J.F. White Contracting Co. and Massachusetts Department of Transportation for stormwater discharges into the Deerfield River not in compliance with the federal Construction General Permit. During an inspection in April 2016, the EPA inspector observed that the construction site had not been stabilized during the past winter months and that Respondents had failed to install proper controls at the storm drains. Under the terms of the CAFO, the Respondents have agreed to pay a $21,600 penalty. The case was initiated based on a tip from the Connecticut River Watershed Association.
