On January 5, 2017, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to the Resource Conservation and Recovery Act (RCRA) to CHI St. Vincent Hot Springs located in Hot Springs, Arkansas. The CAFO was issued in response to violations of: 1) failure to make subsequent notification of its hazardous waste activities in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a), 2) failure to operate within its stated generator status in violation of the regulations set forth 40 C.F.R. Part 262, and 3) failure for the facility to submit its biennial report, for at least one (1) year, in violation of 40 C.F.R. ? 262.41. The CAFO requires CHI St. Vincent to pay a penalty of $105,000.00 and come into full compliance with the RCRA regulations. CHI St. Vincent must respond to EPA Region 6 by April 4, 2017.
