The Regional Judicial Officer issued a Final Order on January 12, 2017, accepting the Consent Agreement to commence and settle violations of CAA Section 112(r)(7), in connection with a natural gas processing plant owned and operated by MarkWest Liberty Midstream & Resources, LLC, known as the Sherwood Gas Processing Plant, and located at 218 Swisher Lane in West Union, West Virginia. EPA conducted an investigation of the facility in response to the release of 19,000 pounds of natural gas liquids on October 9, 2014 due to a hose that was not designed to withstand sufficient pressure. EPA determined that MarkWest had not ensured that its hose in its truck loading area was designed to withstand sufficient pressure to provide safety consistent with applicable industry codes and standards. In addition, EPA determined that MarkWest had not inspected and tested its hoses consistent with the frequency set forth in industry codes and standards. MarkWest has corrected all of the identified conditions at the Facility. In settlement, MarkWest has agreed to pay a cash penalty of $42,893.
