On September 28, 2016, EPA and NYSDEC Region 3 conducted an unannounced inspection of the Brockway Place Transfer Station in White Plains, NY. During the inspection and review of records during and after the inspection, EPA identified that the Respondent was not in compliance with numerous terms and conditions of the NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP), including but not limited to: failure to collect samples at the Facility at the correct location; failure to take corrective actions following quarterly visual and benchmark monitoring identifying the presence of pollutants; failure to modify/keep the Stormwater Pollution Prevention Plan (SWPPP) current; and failure to perform annual employee training for stormwater . In addition, EPA identified an unauthorized/unpermitted leachate discharge at the Facility to the City of White Plains MS4 and the East Branch of the Mamaroneck River. The Order requires the Respondent to cease and desist unauthorized discharges of leachate and stormwater mixed with leachate by implementing short and long-term measures, and requires the Respondent to comply with the terms and conditions of the MSGP.
