On January 17, 2017, Region 1 filed combined complaints, consent agreements and final orders (SuperCAFOs) that simultaneously commenced and settled EPA?s enforcement actions against Brittany Global Technologies Corp (Brittany) and George Kirby Jr., Paint Company (Kirby) for alleged violations of Section 7 of FIFRA, 7 U.S.C. ? 136e. The SuperCAFOs allege that Brittany and Kirby failed to file timely annual pesticide production reports for calendar year 2015 in connection with their respective registered establishments both of which are in New Bedford, Massachusetts. Brittany agreed to pay a civil penalty of $900 to resolve the violation. Kirby agreed to pay a civil penalty of $300 to resolve the violation. The requirement for registered establishments to report production and sales information helps EPA carry out compliance, risk assessment, and risk reduction functions important for protecting human health and the environment. Without annual pesticide production reports, EPA cannot determine where and in what manner pesticides are being produced, sold, and distributed.
