Summary

Huls Bros. Trucking, Inc. was referred to EPA by the Minnesota SERC. Huls reported the storage of 51,590 pounds of diesel fuel on their Tier II report for calendar year 2014 under EPCRA, but failed to submit Tier II reports for 2015. The Minnesota SERC made written and verbal attempts to bring this facility into compliance to no avail. An Information Request was sent by EPA to this facility on August 10, 2016, and a Response was received dated October 11, 2016. Based on that information, Huls was storing 101,250 pounds of diesel fuel. Diesel fuel has a 10,000 pound threshold for reporting. They came into compliance on September 30, 2016. EPA and Huls agreed on an ESA with a civil penalty of $5,000.
