Summary

This case addresses violations of the Act to Prevent Pollution from Ships (APPS) by Eastern Cross Shipping S.A, Toyo Kaiun Co. Ltd., and Pacific Basin Chartering Limited, all operating out of Hong Kong, China. At the time of the violations, Eastern Cross, Toyo Kaiun and Pacific Basin were the owner, operator and charterer, respectively, of the ship King Yukon. On January 26, 2013, the King Yukon entered into the North American Emission Control Area (ECA) and the U.S. Economic Exclusion Zone (EEZ) in transit to the port of New Orleans using fuel oil with a sulfur content of 2.63% m/m. The King Yukon continued to operate in the North American ECA and the U.S. EEZ using fuel oil with a sulfur content of 2.63% m/m until approximately January 31, 2013, in violation of APPS section 1907. As part of the settlement with EPA, Hamburg Cruise S.A. paid a $15,179 civil penalty to the US Treasury.
