On 2-8-2017, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 309 of the Clean Water Act (CWA) to the City of Carlsbad New Mexico. The AO was issued in response to an effluent violation of Section 301 of the CWA; specifically, failure to meet effluent limits and failure to submit a Whole Effluent Toxicity Report. The AO requires the City of Carlsbad to respond to EPA Region 6 within thirty days of the date of the AO.
