On March 13, 2017, EPA Region 10 settled with General Aircraft Services, LLC, of Pendleton, Oregon for violating the Federal Insecticide, Fungicide, and Rodenticide Act. In May 2016, the Oregon Department of Agriculture, on behalf of EPA, investigated a pesticide misuse complaint against General Aircraft Services, LLC. The misuse occurred near Pendleton, Oregon, within the boundaries of the Umatilla Indian Reservation. EPA's investigation found that the pesticide application was in violation of Section 12(a)(2)(G) of FIFRA, 7 U.S.C. 136j(a)(2)(G). EPA concluded that General Aircraft Services, LLC, used the pesticide Fitness (EPA Reg. No. 34704-1031) in a manner inconsistent with its labeling by allowing the pesticide to drift off target. The company agreed to pay a penalty of $1080.
