EES and EPA reached an agreement to a Consent Agreement and Final Order (CAFO) for EES Coke L.L.C. (EES), River Rouge, Michigan to resolve violations regarding failing to comply with the National Emission Standards for Hazardous Air Pollutants (NESHAPs) for Benzene Waste Operations and Equipment Leaks.
Specifically, EES failed to comply with the following: (1) conducting required weekly visual inspections; (2) performing Method 21 sampling properly on valves and pumps; and (3) repeating the determination of total annual benzene quantity after a change in process.
This CAFO requires EES to pay a penalty of $154,000 and EES has also entered in an Administrative Consent Order (ACO). The ACO will require EES to conduct a third-party audit of its Leak Detection and Repair (LDAR) compliance and adopt certain quality assurance measures to ensure LDAR continued compliance. This CAFO resolves violations alleged in a Finding of Violation issued on September 29, 2015.
