On February 21, 2017, EPA Region III issued an Administrative Settlement Agreement and Order on Consent ( Order ) to IndMar Coatings Corporation, the owner and operator of a paints and coatings manufacturing facility located in Wakefield, Virginia. EPA conducted an inspection of the facility to assess compliance with Section 112(r)(1) of the CAA, known as the General Duty Clause. EPA determined that IndMar Coatings Corporation violated the General Duty Clause?s obligation to ensure that the storage of flammable and combustible liquids at the facility was conducted safely so as to prevent accidental releases. With this Order, IndMar Coatings Corporation agreed to ensure that flammable and combustible chemicals are stored in an area with fire protection and spill containment, that containers are labeled properly and accumulated safely, and that an emergency plan will be submitted to local responders. Issuance of this Order will improve public health and safety by decreasing the risk of releases of hazardous chemicals.
