On February 22, 2017, the Regional Judicial Officer entered a Final Order ratifying a Consent Agreement between EPA and Zambelli Fireworks Manufacturing Company (Zambelli). The CAFO resolves allegations Zambelli violated the terms of its RCRA C thermal treatment permit by: 1) failing to keep an inventory of hazardous waste fireworks and the method(s) and date(s) of its treatment, storage, or disposal at the Facility; 2).failure to train employees managing hazardous waste; 3) failure to have a closure plan; 4) failure to have a closure plan estimate; 5) failure to maintain financial assurance for closure; 5) failure to operate the burn unit in accordance with the terms of the permit, 6) failure to maintain security of the Facility perimeter, 7) failure to maintain and operate the Facility to minimize the possibility of a fire, explosion, or release of hazardous waste or hazardous waste constituents. Zambelli will pay a cash penalty of $223,448.00.
