On February 22, 2017, EPA Region 2 signed an administrative settlement agreement and order on consent (AOC) under CERCLA for investigatory vapor intrusion sampling at 20-30 Garvies Point Road in Glen Cove, New York. EPA determined the need for vapor intrusion sampling at the subject property during an investigation of the former Mattiace Petrochemical facility, which is located adjacent to the property. Pursuant to the AOC, two corporations, the owner of the property to be investigated, and a neighboring property owner have agreed to collect indoor air and sub-slab vapor samples at the property in question by March 31, 2017, which marks the end of the relevant indoor heating season. EPA may require that the Respondents perform an additional round of sampling at the property at a later date, and any oversight costs incurred by EPA will be reimbursed by the Respondents.
