On February 22nd, 2017, U.S EPA Region 6 Waste Enforcement Branch, Waste Compliance I Section finalized a Consent Agreement and Final Order with Memorial Hermann Health System. The settlement included 5 facilities of Memorial Hermann Health System; Memorial Hermann Southwest Hospital, Memorial Hermann Southeast Hospital, Texas Medical Center, Memorial City Medical Center and The Woodlands Hospital. The six main violations addressed under this settlement were Failure to File Initial and Subsequent Notification pursuant to section 3010 (a) of RCRA, 42 U.S.C ? 6930 (a); Managing Hazardous Waste Without an EPA ID Number pursuant to 40 C. F.R ? 262.12 (a); Failure to Meet the Requirements of a Small Quantity Generator pursuant to 40 C.F.R. ? 261.5 (a) (b); Failure to Fully Comply with Manifest Requirement pursuant to 40 CFR Appendix to Part 262; and, Failure to Make Adequate Hazardous Waste Determinations.
