On July 12, 2017, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to the Clean Air Act (CAA) to TPC Group LLC located in Port Neches, Texas. The CAFO was issued in response to violations of 40 C.F.R. ?? 60.11(d). The CAFO requires TPC Group LLC to pay a civil penalty of $72,187, install flare monitoring equipment and automated controls, complete a mitigation project, and complete a supplemental environmental project (SEP) of no less than $275,000 to conduct continuous fence line monitoring for 1,3-butadiene.
