Ferrara Pan Candy Company violated their Federally Enforceable State Operating permit by failing to properly operate the catalytic oxidizer, used for VOC control, and operated when the oxidizer was below temperature, causing excess emissions. EPA inspectors visited the facility for an unannounced inspection and discovered that the oxidizer was not operating at the correct operating temperature while the facility was in operation. Circle chart records highlighted many occurrences when Ferrara was not monitoring the temperature and many other occurrences when the oxidizer was below the minimum operating temperature. Ferrara is required to install a new digital temperature monitor on their catalytic oxidizer, improve the record keeping on their emission units vented to the oxidizer, which will resolve the violations set forth in the NOV issued to Ferrara on June 8, 2016. Ferrara has also agreed to settle this matter by paying a civil penalty of $158,500.
