EPA and Respondent came to agreement in a CAFO regarding violations of CERCLA 103a- failure to notify NRC regarding release of ethylene oxide on March 30,2016, and violations of EPCRA and failure to notify the SERC and LEPC of this release. Respondent did not immediately notify NRC of the release on March 30, 2016. Respondent did not immediately notify the SERC after Respondent had knowledge of the release. and did not immediately notify the LEPC of the release. The CAFO included a $5,529 civil penalty for the CERCLA violation, a $11,059 for the EPCRA violations, totaling $16,588 for the civil penalty. BASF also agreed to a Supplemental Environmental Project (SEP) costing at least $62,289.65 to purchase equipment to be donated to the Wyandotte, Michigan Fire Department.
