On September 18, 2018, the Consent Decree between EPA and Golden Valley Electric Association, Inc., was entered. The alleged violations include failure to meet the mercury emission limit, failure to install required mercury monitoring, and failure to timely conduct required source tests and submit source test reports under Section 112 of the CAA, 42 U.S.C. 7412, and the National Emissions Standards for Hazardous Air Pollutants from Coal-Fired Electric Utility Steam Generating Units, 40 C.F.R. Part 63, Subpart UUUUU (also referred to as the Mercury Air Toxics Standard or MATS). Some of these failures also violated an existing consent decree with GVEA signed in 2012.
