## Summary

Respondent failed to timely submit a completed Emergency and Hazardous chemical inventory form to the  Minnesota SERC and the Caledonia Fire Department including  diesel fuel, sulfuric acid and nitric acid for calendar years 2011,2012 and 2013. Respondent did submit these forms on June 23, 2014.This was a violation of Section 312 of EPCRA. Respondent and EPA agreed on a $12,749 civil penalty. Respondent also agreed to complete a supplemental environmental project (SEP) to protect the public health  and environment by providing emergency response equipment to local emergency response agencies in Houston County, Minnesota: $2,344 in equipment to the Brownsville Fire Department, $1,369 in equipment to the Spring Grove Fire Department, $15,367 to the Eitzen Fire Department, and $27,227 to the Caledonia Fire Department. Said equipment's total expenditure is $46, 497.  As of June 6, 2017 the agency had receiver respondent's final SEP completion report and had satisfied the SEP requirements of the CAFO.
