Seeking to reach a judicial settlement pursuant to which the Defendant will fund and implement the remedial action called for in EPA's September 29, 2015 Record of Decision (ROD), except for the portion already being implemented by the Defendant under an EPA administrative order, fund and implement the remedial design and remedial action (RD/RA) for the future ROD for the soils and contaminated groundwater at the Hilliards Creek Site, fund and implement the RD/RA for the future ROD at the U.S. Avenue Burn Site, fund and implement the RD/RA for the future ROD for water bodies located within the sites, and reimburse the EPA for its costs in overseeing the Defendant's performance of all work.
Supplemental referral sent on January 5, 2021 for modification of the Omnibus Consent Decree. The CD Modification will add the Remedial Design/Remedial Action (RD/RA) Statement of Work for Operable Unit 2 (OU2 SOW) of the Sherwin-Williams/Hilliard's Creek Superfund Site.
The second CD Modification provides for the performance of the remedy for waterbodies at the Sherwin-Williams/Hilliard's Creek Site selected in the SW/HC OU4 ROD in accordance with the terms of the decree and the statement of work.
