On May 25, 2012, at or about 12:15 p.m. (CT), a release occurred from Respondent's facility of approximately 97.1 pounds of chlorine. Respondent had knowledge of the release on May 25, 2012, at approximately 12:45 p.m. CT. Respondent had knowledge of the release on May 25, 2012, at approximately 12:45 p.m. CT. Respondent notified the NRC of the release on December 3, 2016. Respondent did not immediately notify the NRC as soon as Respondent had knowledge of the release. Respondent's failure to notify immediately the NRC of the release is a violation of Section 103(a) of CERCLA. A civil penalty of $39,384 was agreed to.
