EPA alleged that Respondent, owner or operator of the facility at 1901 Ames Drive, Burnsville, Minnesota failed to timely submit a completed emergency and hazardous chemical inventory form (Tier I or Tier II form) for the calendar year 2015 as required by Section 312 of EPCRA. Respondent was required to submit its Tier I or Tier II form for calendar year 2015 on or before March 1, 2016,. Respondent filed the required form on October 18, 2016. EPA and Respondent agreed to an appropriate civil penalty of $5,000.
