EPA issued an Administrative Consent Order (ACO) commencing and concluding an action against Ervin Industries, Inc. (Ervin) for alleged violations of the Clean Air Act. The ACO alleges that Ervin failed to operate in accordance with good air pollution control standards by venting emissions from an electric arc furnace (EAF) directly to the atmosphere. The ACO requires Ervin to incorporate modifications already completed to its melt shop wall fans into its Title V permit, thereby reducing particulate matter emissions from the EAF.
