The owner and operator of the sites located in the Town of Wallkill, NY, were cited for violations consisting of unauthorized discharge of fill material into jurisdictional waters without a permit, including stream straightening, as well as concentrated animal feeding operations without a permit, and stormwater construction general permit violations. The CD requires payment of a $200,000 civil penalty. In addition, for the injunctive relief, Defendants must: create or restore approximately 18 acres of wetlands on their property, restore two streams to their pre-fill configurations, take additional measures to ensure the long-term success of the Defendants' restoration work, and come into compliance with federal CAFO regulations. The estimated cost of the injunctive relief is $2,756,435.
