On February 16, 2017 the U.S. EPA Region 5 Water Division Director issued an Administrative Order (Order) to the Village of Weldon (Weldon) under Section 1414(g) of the Safe Drinking Water Act, 42 U.S.C. ?? 300g-3(g). The Order outlines actions Weldon must take to ensure that its public water system (PWS) complies with the arsenic maximum contaminant level (MCL) by no later than December 31, 2017.
On August 3, 2016, the Illinois Environmental Protection Agency (IEPA) notified Weldon?s PWS of its noncompliance with the arsenic MCL. On August 18, 2016, Weldon responded to IEPA that it changed the primary well to the well with the lowest arsenic levels. Weldon submitted a supplemental response to IEPA on September 16, 2016, saying that Weldon was submitting applications for financial assistance to USDA Rural Water Development for six projects necessary for the water system, and Weldon was not ready to enter into a Compliance Commitment Agreement due to the remaining uncertainty in the specific course of action necessary to obtain compliance. IEPA sent Weldon a Notice of Non-Issuance of Compliance Commitment Agreement on November 29, 2016. IEPA referred Weldon?s noncompliance to EPA for enforcement on November 29, 2016. EPA contacted Weldon to discuss measures necessary to return its PWS to compliance. EPA?s order places Weldon on an enforceable schedule to comply with the requirements of SDWA.
