On September 1, 2016, EPA Region 2 conducted an inspection of the Respondent's Combined Sewer System. As a result of the inspection, EPA identified that the County is not in compliance with its NYSDEC State Pollutant Discharge Elimination System (SPDES) Permit for failing to implement certain Best Management Practices for Combined Sewer Overflows required by the Permit. In addition, the County failed to implement projects required under its Long Term Control Plan and failed to submit a Post-Construction Monitoring Plan to the NYSDEC. Lastly, an unpermitted outfall that discharges stormwater, and occasionally overflows from the County?s Wastewater Treatment Plant equalization tank, was identified at the at the time of the inspection. This Information Request and Administrative Compliance Order requires the County to comply with the terms and conditions of its SPDES permit and seek SPDES permit coverage for the above-mentioned outfall.
