On July 10, 2017, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by The Jerry Brown Co., Inc. located in Eugene, Oregon. Respondent, which operates a fuel tank loan program, had a tank release of an estimated 900 gallons of diesel fuel due to a hole created by tank corrosion. The tank release discharged fuel oil to waters of the U.S., without a permit, that provide habitat for anadromous fish. The company's contractors boomed the affected surface waters and conducted remedial actions to recover the spilled fuel. EPA and the Oregon Department of Environmental Quality collaborated on a joint enforcement action. The company agreed to pay a penalty of $9,900 to EPA, and as part of the settlement, they agreed to pay a penalty of $13,200 to the State of Oregon.
