Respondent violated provisions of the Risk Management Plan regulations promulgated pursuant to Section 112(2) of the Act. Those violations included failure to: document names and positions of responsible persons for implementing requirements of the risk management program elements, analyze and report worst case release quantity, establish Process hazard Analysis team findings and recommendations, train employees in operating the process, correct deficiencies in equipment that were outside acceptable limits before use, prepare a report at the conclusion of an accident investigation, to establish a system to promptly address and resolve, and to update emergency contact information in the Risk Management Plan within one month of any change in the emergency information. The settlement civil penalty was $5,820.
