On July 13, 2017, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Mt. Baker Products, Inc. ( Respondent ). Respondent, which operates a wood products manufacturing facility, discharged pollutants to waters of the U.S. and was found to be operating in violation of the Washington State NPDES Industrial Stormwater General Permit. Violations include failure to develop a complete stormwater pollution prevention plan, failure to implement best management practices, failure to monitor discharges properly, failure to conduct corrective action, and failure to properly document required self-inspection. The company is now operating in compliance and doing so will reduce the amount of stormwater discharges into Bellingham Bay. Bellingham Bay is a part of Puget Sound. Bellingham Bay and Puget Sound are anadromous fish passage waters. The company agreed to pay a penalty of $52,700.
