Summary

U.S. EPA, Region 5, entered into an Administrative Consent Order (ACO) with Advanced Disposal Services Arbor Hills Landfill (Advanced Disposal) to resolve Clean Air Act (CAA) violations that occurred at its municipal solid waste (MSW) landfill, Arbor Hills Landfill (the Landfill), located at 10690 West Six Mile Road, Northville, Michigan. From January 2016 until February 2017, nearby residents of the Landfill had filed hundreds of odor complaints indicating that landfill gas was not being captured from the Landfill. EPA conducted two inspections on the Landfill and collected additional information from Advanced Disposal and other parties involved with site operations. EPA issued a Finding of Violation (FOV) to Advanced Disposal alleging that it violated the Landfill NSPS and NESHAP regulations by failing to maintain cover integrity and good air pollution control practices, leading to fugitive emissions of landfill gas. Advanced Disposal has since installed an additional temporary flare and multiple new gas wells. The ACO requires Advanced Disposal to carry out and adjust, based on field investigations, a compliance plan that requires improvements to the gas collection and control system, landfill cover and water removal from inside the Landfill. Advanced Disposal is also required to submit monthly reports showing the work performed that month and the progress of uncompleted projects in addition to quarterly reports showing data on well, control and surface monitoring.
