On July 31, 2017, Region 10 filed an expedited settlement agreement resolving violations of the Clean Water Act by Sunroc Corporation and Barber Valley Development, located in Boise, Idaho. Respondents operate a construction site and pumped and discharged groundwater that was occasionally turbid to Warm Springs Creek and the Lower Boise River from excavations. Respondents pumped and discharged without any turbidity monitoring in violation of EPA's Stormwater Construction General Permit. Proper turbidity monitoring for pumped and discharged groundwater and ensuring dewatered effluent has been effectively managed by appropriate controls help protect Warm Springs Creek and the Lower Boise River and important uses, namely cold water aquatic life, salmonid spawning, domestic water supply, and primary and secondary contact recreation. The companies agreed to pay a penalty of $1,650.
