On May 17, 2017, Region 1 filed an Administrative Complaint against Ferti Technologies, Inc. (Ferti) for alleged violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The Complaint alleges that Ferti violated Section 12(a)(2)(N) (failure to file reports of pesticide/device imports) of FIFRA, 7 U.S.C. ? 136j(a)(2)(N), and the regulations promulgated pursuant to FIFRA at 40 C.F.R. Part 152 et seq. and 19 C.F.R. ?? 12.110 ? 12.117.
The Complaint specifically alleges that on April 26, 2015, Ferti imported a single shipment of four pesticide products from Canada into the United States without submitting the required Notice of Arrival reports with EPA prior to their arrival
