Summary

On November 7, 2016, the EPA sent an information request to Rosebud Recycling, LLC (Facility) for information pursuant to section 308 of the Act, 33 U.S.C. ?1318. The purpose of the information request was to determine whether the Facility needed to obtain a Multi-Sector General Permit for Storm Water Discharges Associated with Industrial Discharges (Permit). Information received from Rosebud Recycling, LLC, indicated the company runs a scrap and waste material recycling facility. Stormwater runoff containing pollutants from the facility has flowed into an unnamed drainage south of the site, that flows into the Missouri River drainage system. The Missouri River is a navigable water and a water of the US. Scrap and waste material recycling facilities that discharge pollutants in stormwater to a water of the U.S. are required to obtain a Permit. Rosebud Recycling, LLC agreed to enter into an administrative order on consent (AOC) that was issued on May 12, 2017. The AOC requires Rosebud Recycling to obtain and comply with an industrial stormwater permit pursuant to section 402 of the Clean Water Act.
