On September 13, 2017, Region 10 filed an expedited settlement agreement resolving violations of the Clean Water Act by Liberty Development, Inc. and Trilogy Development, Inc., located in Boise, Idaho. Respondents operate the Chesterfield Subdivision No. 4 construction site in Meridian, Idaho where they failed to fully implement dewatering and other best management practices required by EPA's Stormwater Construction General Permit. Implementing required best management practices (BMPs) helps limit sediment inputs from dewatering activities and construction stormwater discharges to Ten Mile Creek and the Lower Boise River. Ten Mile Creek and the Lower Boise River are listed as impaired waterbodies due, in part, to sedimentation/siltation. Required monitoring of dewatering discharges helps ensure BMPs are working. The companies agreed to pay a penalty of $2,500.
