## Summary

On June 14, 2017, the Regional Judicial Officer entered a Final Order ratifying a Consent Agreement between EPA and Indmar Coatings Corporation, (Indmar), a paint manufacturer located in Wakefield, Virginia. This case was referred to EPA by the Virginia Department of Environmental Quality (VADEQ).  The CAFO resolves alleged violations of Subtitle C of RCRA, and the authorized VHWMR. The allegations included Indmar's failure to make waste determinations, storage of hazardous waste without interim status or a permit, failure to remedy deterioration or malfunction of equipment so that such deterioration does not lead to an environmental or human health hazard, failure to conduct hazardous waste management training, failure to maintain and operate the Facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste, failure to transfer hazardous waste being stored in containers that were leaking, rusting, and bulging to containers in good condition, failure to inspect areas where containers of hazardous waste were stored. These violations were identified during EPA inspections in 2014 and 2016.  Previously this year, Indmar entered into an Order on Consent under 112r of the Clean Air Act. In addition, Indmar was convicted in 2003 of Virginia Fire Code violations and in 2005 of Virginia Safety and Labor violations. Until 2012, Indmar had been the subject of a VADEQ RCRA Order.
