On June 5, 2017, EPA Region III executed a SCAFO with Lititz Borough, Pennsylvania (Lititz), for Lititz to pay a penalty of $3,000 to resolve alleged violations of its NPDES Small MS4 Permit. The MS4 program ? and thus the permit - is designed to prevent harmful pollutants from urban areas from being dumped or washed into separate storm sewer systems and into local water bodies. Based upon an EPA inspection in October 2014, EPA determined that the Borough was violating its MS4 permit by failing to fully develop and implement a SWMP. Lititz had not fully implemented MCM#3 - illicit discharge detection and elimination program; MCM#5 - post-construction stormwater management; and MCM#6 ? pollution prevention/good housekeeping for municipal operations. Subsequent to the EPA inspection, Lititz undertook the actions required to come into compliance. The SCAFO was subject to a 40-day public comment period and no comments were received. PADEP participated in the inspection and supported the enforcement action.
