On June 22, 2017, EPA issued an Administrative Compliance Order (ACO) against Respondent for its failure to submit a Notice of Intent (NOI) application to obtain coverage under the 2016 Small MS4 General Permit. The ACO requires the Respondent to file a NOI and submit a cost report detailing the expenses in which the Municipality incurred in order to develop and file the NOI.
