On August 31, 2017, Region 10 filed a consent agreement and final order against Russell Vessey of Kamiah, Idaho, resolving a violation of the Clean Air Act Federal Air Rules for Indian Reservations (FARR). Respondent violated the general rule for open burning by burning prohibited materials, such as construction debris and plastics, at a residential property in Kamiah, Idaho, owned by Respondent and located within the boundaries of the Nez Perce Indian Reservation. Burning prohibited materials results in increased air pollution. Respondent agreed to pay a penalty of $192. This penalty was derived using the FARR penalty policy. These penalties are intended to correct and deter environmental violations in EJ areas by assessing a penalty that is proportional to the issue and the entity. This penalty is appropriate for a single individual burning a small amount of construction debris.
