Case involves Respondent's failure to include within or as an attachment to contracts to lease target housing units: a lead warning statement; statement disclosing the presence of known lead-based paint and/or lead-based paint hazards or indicating no knowledge; a list of any records or reports pertaining to lead-based paint and/or lead-based paint hazards or indicating no such reports or records are available; and a statement by the lessee affirming receipt of information, records, or reports and the lead-hazard information pamphlet. EPA is seeking a penalty and the company's return to compliance. Initial proposed penalty of $347,790 was significantly reduced based on Respondent's demonstrated inability to pay based on financial documents submitted by Respondent. New penalty amount based on inability to pay was $3,000.
