EPA issued a Consent Agreement and Final Order (CAFO) commencing and concluding an action against Johnson Controls Battery Group, Inc. (Johnson Controls) for alleged violations of the Clean Air Act. The CAFO alleges that Johnson Controls exceeded PM and lead emission limits and failed to operate a pollution control device as required by its operating permit. The CAFO also alleges that Johnson Controls failed to properly record operating parameters for a pollution control device as required by the NESHAP for Lead Acid Battery Manufacturing Area Sources. The CAFO requires Johnson Controls to pay a $20,000 penalty and perform a $26,000 supplemental environmental project (SEP). The SEP includes installation and operation of a baghouse monitoring and historical data recording system to allow for immediate alarm and notification in the event that differential pressure falls outside of operating ranges.
