This case involves failure by Morgan Stanley Capital Group Inc. (MSCG) to comply with the Clean Air Act Reformulated gasoline (rfg) standards at 40 C.F.R. ? 80.65(i)(3)(i).
MSCG disclosed to EPA on June 2, 2015 that it had produced 97.3 million gallons of rfg during the 2013 and 2014 ozone control periods by blending previously certified gasoline with blendstocks. The gasoline failed to comply with the volatile organic compounds standard required by 40 C.F.R. ? 80.65(i)(3)(i).
As part of the settlement, MSCG agreed to pay a civil penalty of $1,119,000 to the U.S. Treasury.
