Summary

Region 3 Enters into Super CAFO with Polyone Designed Structures and Solutions, LLC, Salisbury, Maryland to Resolve RCRA Subtitle C Violations. On July 18, 2017, EPA Region 3 and PolyOne Designed Structures and Solutions, LLC entered into an agreement that both initiates and resolves the company's RCRA Subtitle C violations. Through an EPA inspection in 2015 and follow-up information request letter in 2016, the Region determined that PolyOne, aprovider of specialty polymer formulations and other laminate coatings, was responsible for the following violations of the authorized Maryland Hazardous Waste Management Regulations set forth at the Code of Maryland Regulations, Title 26, Subtitle 13 et seq.; (1) operation without a permit or interim status; (2) failure to make hazardous waste determinations; (3) failure to keep hazardous waste containers closed when not adding or removing waste; and (4) failure to update the facility's contingency plan. Maryland's Hazardous Waste Management Regulations are enforceable by EPA under Section 3008(a) of Resource Conservation and Recovery Act, 42 U.S.C. 6928(a). PolyOne has agreed to pay $29,960.00 for these violations. The RCRA C regulatory program creates a management regime for hazardous waste designed to prevent the release of hazardous waste to the soil, water and air. RCRA C regulations track hazardous waste from the point of generation to the point of treatment and/or disposal. These violations increase the risk of a release
