## Summary

On September 17, 2017, EPA Region 10 settled with RCO International Inc. of Harrisburg, Oregon for violating the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). In May 2015, the Oregon Department of Agriculture, on behalf of EPA, conducted an inspection of RCO International. The subsequent EPA Region 10 investigation along with information collected by EPA Region 8, during marketplace inspections, found that RCO International sold misbranded pesticides, in violation of FIFRA. Specifically, the products Omega Gopher Grain Bait (EPA Reg. No. 5042-32) and RCO Avalon (EPA Reg. No. 5042-34) did not bear correct storage and disposal statements as required under EPAs Pesticide Container and Containment Regulations. The products failed to instruct the user not to reuse the container after use, among other requirements. Both products contain the active ingredient strychnine and these violations increased the risk of exposure to harmful residues left in the containers after initial use. The company agreed to pay a civil penalty of $25,400.
