On August 23, 2017, EPA Region V filed a CAFO with Mahle Behr USA, Inc. The CAFO resolves failure of Respondent to immediately notify the federal, state and local emergency response authorities following a release to the air of 900 pounds of anhydrous ammonia from its Troy, Michigan facility in violation of Section 103(a) of CERCLA and Section 304(a)(1) of EPCRA. Mahle will pay a civil penalty of $54,000.
