On September 6, 2017, the Regional Judicial Officer entered a Final Order ratifying a Consent Agreement between EPA and Quad/Graphics, Inc., resolving violations of the West Virginia Hazardous Waste Management regulations and the Resource Conservation and Recovery Act (RCRA) Subpart C regulations observed during an EPA inspection conducted on September 14, 2016 and a subsequent investigation of Quad/Graphics. Quad/Graphics? printing facility is located in Martinsburg, West Virginia. A representative of the West Virginia Department of Environmental Protection participated in the EPA Compliance Evaluation Inspection of Quad/Graphics? facility.
Quad/Graphics allegedly violated RCRA Subtitle C regulations by operating a hazardous waste storage facility without a permit, interim status or a valid exemption to the permit requirement; failing to conduct hazardous waste determinations on solid waste generated at the facility; failing to inspect weekly all areas of the facility where containers of hazardous waste were stored, and failing to keep containers holding hazardous waste closed except when it is necessary to add or remove waste. Quad/Graphics will pay a $31,880 civil penalty.
