The Respondent operates a dry dock facility located at the Brooklyn Navy Yard in Brooklyn, New York. EPA previously issued two Administrative Compliance Orders (CWA-02-2014-3050 and CWA-02-2016-3036), an Administrative Penalty Order (CWA-02-2016-3402) and an Order to Show Cause (CWA-02-2017-3066) to the Respondent for MSGP violations, including failure to remove waste grit from the dry dock prior to flooding. As required by the Order to Show Cause, GMD appeared at EPA on August 17, 2017 and subsequently submitted a proposed compliance schedule to complete spent grit removal from the Facility. This Order memorializes the proposed schedule to achieve compliance with the MSGP.
