## Summary

Green Way Solutions sells hydrocarbon refrigerant products, called HC22a/502a+ and HC12a/134+, and markets them as drop-in replacements for the Class II Ozone-Depleting Substance (ODS) HCFC-22 (also known as R-22), the Class I ODS R-502, which is a blend of HCFC-22 and CFC-115 (a Class I substance) and the Class I ODS CFC-12 (also known as R-12). No notice of intent for HC22a/502a or HC12a/134+ has been submitted to EPA for the required review and EPA has not approved HC22a/502a or HC12a/134+ as a substitute for R-22, R-502 or R-12. As such, Green Way Solutions introduced HC22a/502a and HC12a/134+ into commerce before the expiration of 90 days after initial submission to EPA of the notice of intent, in violation of the SNAP regulations at 40 C.F.R. ï¿½ 82.174(a) and has used HC22a/502a  and HC12a/134+ in violation of the SNAP regulations at ï¿½ 82.174(b).

This ACO requires, among other things, Green Way Solutions to cease use of HC22a/502a and HC12a/134+, or any other substitute or alternative for an ODS, unless and until an initial notification for such product has been submitted to the EPA SNAP program and it has been approved by EPA as a substitute under the SNAP program and to notify all known past customers of the potential safety hazards associated with HC22a/502a and HC12a/134a+. This ACO addresses the violations set forth in the FOV issued to Green Way Solutions on August 30, 2016.
