On September 28, 2017, EPA signed an Expedited Consent Agreement and accompanying Final Order (CAFO) with Spray Products Corp. for violation of Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) requirements. Spray Products Corp. failed to submit their Annual Pesticide Production report for 2016 by the annual March 1st due date for their pesticide-production facility located in Upland, PA. When their report was submitted, Spray Products Corp. reported zero-production for 2016. Spray Products Corp. agreed to inactivate their Upland, PA establishment number and, as a result, will not be assessed a monetary penalty. This also means that they can no longer produce pesticides at this location. EPA-registered pesticide-producing establishments are required to submit their production reports annually to the Agency, listing the names and types of pesticides they produce, the amounts produced and distributed in the previous year, and the amount they expect to produce in the coming year.
